The FGTS was created with the aim of providing a kind of financial reserve for workers, so that they could have access to a sum of money in times of financial insecurity, such as in cases of dismissal without just cause. For each salary received by an employee with a formal contract, 8% is directed to the FGTS account, linked to Caixa Econômica Federal. The money can be withdrawn in case of dismissal without just cause, in the worker's retirement or in specific situations.
Extra income of up to R$ 10 thousand through FGTS review
To request the revision, the worker must have a balance in the FGTS between 1999 and 2013, if approved. In addition, this group of workers can receive up to R$ 10,000, but the amount may vary according to the accumulated amount in the period described in the action.
If the worker is entitled to receive an amount of up to 60 minimum wages, considering the current national floor, and the revision is approved by the STF, he can apply online, on the website of the Federal Court of the region where he lives.
However, if the amount to be received exceeds the limit of 60 minimum wages, the process must be opened in a Federal Court. Therefore, it is essential that the worker consults a specialist lawyer in the area to obtain all the necessary legal guidance.
